Contract
Purchaser agrees to the following:
1. This cat/ kitten will never be sold, transferred, leased or given away, nor sold to any pet shop, research laboratory or similar facility.
2. This cat or kitten will be kept indoors and not be allowed to roam freely outside.
3 If this cat or kitten is found to be neglected or mistreated, Purchaser will surrender said cat or kitten to Seller.
4 This kitten will receive excessive amounts of tender loving care, will be fed the best possible diet, will receive substantial amounts of entertainment, and will be treated with the utmost respect so that he/she may realize it's full potential.
5. No cash refunds.
6. The queen must be at least 12 months old before she can be bred.
7. If this cat is purchased as a breeder male, Purchaser agrees not to use this cat for outside stud. No co-ownership, transfer of queen's ownership, or other devious means of circumventing this restriction, will be tolerated. Any queen bred by this stud, and subsequent litter must be owned entirely by the owner of the stud. There will be a RM 10,000 ine for each and any breech of contract. Once the contract is breeched, buyer is to surrender the cat back to the seller without refund and at the buyer’s expense. Also, a stud male is not to be resold as a breeder. Once buyer no longer wants to keep him as a breeder, he must be neutered and re-homed as a pet., the queen must be rehome as a spayed cat and NOT as a breeder.
8 . Kittens sired and produce by a Pendekar cat are prohibited to be display,loan, sold, or advertise for sale in mudah.com. E Bay or any on line auction web site
9.. If this cat is purchased as a breeder, Purchaser agrees to breed this cat only with other Bengals. Failure to honor this will result in forfeiture of the cat and registration papers back to original breeder.
10. This cat or kitten is being fed Nutriedge/Royal Canin / Iams kitten/cat food, dry, free choice. Give canned meat twice daily as a treat.
GUARANTEES
The cat/kitten is guaranteed to be of sound health upon arrival. It is guaranteed for a period of 72 hours from the time of purchase (arrival) if vet-checked within that time. It is recommended that the new cat/kitten be in quarantine for 2 weeks. If it is found to be medically deficient with an untreatable or life-threatening problem, it must be reported to the seller immediately. Upon its return, it will be replaced with another kitten/cat of equal value or the purchase price will be refunded. If no replacement is available at that time, seller will have 6 months to furnish satisfactory replacement. The cat/kitten cannot be returned after the guarantee period has expired and/or if it has been exposed to another cat which has not been currently tested for FeLV and FIP. It is the responsibility of the buyer to provide immediate veterinary care to any cat/kitten showing signs of illness or distress and failure to do so will render any guarantee null and void. Under no circumstances is a kitten to be destroyed prior to notification by the buyer to the seller. If a cat/kitten dies within the guarantee period, despite medical treatment, compensation will be made ONLY if a veterinarian certifies the cause of death. All veterinary fees are the sold responsibility of the Buyer.
This cat/kitten is guaranteed against congenital defects for 6 months. Should the cat die within that time as a direct result of a congenital defect, the cat will be replaced ONLY if an appropriate necropsy is performed by a licensed vet and a vet's certificate is provided as proof of cause of death. A replacement will be made of a cat of comparable quality and value, as available, at the discretion of the breeder. Due to the many factors involved in rearing and caring for this kitten that are beyond the control of the seller, there are no guarantees on fertility or temperament.
There are no guarantees that kittens sold as show quality, will necessarily win at the shows, since there are so many other factors involved in winning.....like politics, competition, regional trends, grooming, socialization of the cat, and individual judges' perception of the standard
If Buyer at any given time decides to sell this cat/kitten, seller will be given the first opportunity to buy the said cat/kitten back at ½ the purchase price, otherwise it will must be spayed/neutered before placing with anyone else.
Along with this contract, is a document to be presented to and filled out by the new owner's vet, regarding the condition of the kittens' health on arrival. This contract, and all guarantees, will be null and void unless the signed contract and vet's statement on the document is returned to the seller within 2 weeks . This contract is legally binding to all parties involved. It applies only to the buyer and seller in this transaction and is non-transferrable to other parties. If this kitten/cat is resold to another individual, this contract is null and void. The buyer agrees to the terms and conditions, and to pay as stated.
If Buyer or Seller commences any legal action as a result of this contract, Buyer agrees that the place of venue of such action shall be in Malaysia . Any legal fees incurred in upholding this contract will be paid by the Buyer.
